    Financial issues and divorce

    When a marriage ends, there are many financial issues that have to be addressed. New Hampshire has rules, guidelines, and policies addressing divorce issues. The types of financial issues that are most common in divorce vary from one situation to another. Some of the most frequently occurring issues include:

    • Spousal support/Alimony:  This involves payments made by one spouse to another as a result of an income or earning disparity between the spouses. This support may be temporary if time is needed to get back into the job market, or it may be long term support.
    • Division of property: Generally, equitable distribution rules are used in New Hampshire, which means that all assets that belong to one or both of the parties (including their partial ownership) are divided in a way seen as fair, but this division is not always equal.
    • Pensions, stocks, 401k and retirement: These accounts are often allocated between the parties. Something called a Qualified Domestic Relations Order may be needed to complete the allocation.
    • Business: When a spouse owns a business, the other may receive compensation equal to a portion of the businesses' value.
    • Real Estate: It must be valued and can be sold, or made into an agreement to allow one spouse to purchase the other's interest in a lump sum, or payment over time.
